Description
a. Participation by Participants) and Guardian may include, among other activities, putting on sneakers that will be provided and engaging in movement and play, as well as communicating their impressions and answering questions about their experience.
Purpose of Research
a. The Research Study is being conducted solely for Jack Strategy and Client's internal purposes only.
Voluntary
a. Participation in the Research Study is completely voluntary. Participant(s) and Guardian may withdraw at any time. Participants) and Guardian agree that they are voluntarily participating in the Research Study and such participation is entirely at their own risk.
Physical Activity
a. The Research Study includes physical activity, including but not limited to marching, jogging, jumping and tapping. If at any time the Participants) or Guardian feels unwell or needs to stop, the Participants) or Guardian may pause participation in the activity or withdraw from the Research Study.
Audio/Video Recording
a. Participants) and Guardian hereby consent to Jack Strategy and its Client using audio, video, digital, photographic and other mediums to record and document each Participant's and Guardian's participation in the Research Study, including each Participant's and Guardian's likeness and image.
b. Participants) and Guardian irrevocably grant to Jack Strategy the right to record, reproduce, arrange, edit, exhibit, distribute, and otherwise use each Participant and Guardian's name, biographical information, performance, voice, portrait, photograph, and/or other likeness as well as any quotes given by a Participants) or Guardian
(collectively, the "Materials* without restriction in whole or in part in any manner or medium, whether now known or hereafter developed, including, but not limited to, print media, electronic media, and the internet, without limitation as to frequency throughout the universe in perpetuity, for any legal and internal business purpose.
c. Participants) and Guardian waive any right to inspect or approve the Materials, and any rights to compensation in connection with its use.
Confidentiality
a. Participants) and Guardian shall maintain the confidentiality of the Research Study, including the Client name, the content of the Research Study, and any other information obtained or learned during the Research Study. This means you may not discuss or otherwise share any details of the Research Study with any third parties in any manner,
including using social media platforms.
COVID-19
a. Jack Strategy requires that Participants) and Guardian be fully vaccinated for COVID-19.
b. Guardian hereby represents that they:
◻ are fully vaccinated against the COVID-19 virus
◻ are not fully vaccinated against the COVID 19 virus
c. Guardian hereby represents that Participant #1:
◻ is fully vaccinated against the COVID-19 virus
◻ is not fully vaccinated against the COVID 19 virus
d. Guardian hereby represents that Participant #2: (mark N/A if only one child participates)
◻ is fully vaccinated against the COVID-19 virus
◻ is not fully vaccinated against the COVID 19 virus
◻ N/A
For purposes of this Research Study, fully vaccinated does not require having received the recommended booster shots. If the Participants) and Guardian in attendance cannot attest to full vaccination, they cannot participate in the Research Study.
Waiver and Release
a. Participants) and Guardian on behalf of themselves, their heirs, executors, administrators, assigns, or personal representatives (including Participant's parents or guardian if Participant is under 18 years of age), hereby release and forever discharge each of Jack
Strategy and its Client, including their affiliates and each of their respective officers, directors, members, employees, agents, shareholders and independent contractors, from any and all claims, liability, actions, suits, demands, costs, expenses and indebtedness
arising out of, related to, or in any way connected with the Research Study and the Materials.
b. Participants) and Guardian on behalf of themselves, their heirs, executors, administrators, assigns, or personal representatives (including Participant's parents or guardian if Participant is under 18 years of age), hereby release and forever discharge each of Jack
Strategy and its Client, including their affiliates and each of their respective officers, directors, members, employees, agents, shareholders and independent contractors, from any physical injury that such Participant or Guardian may suffer as a result of their participation in the Research Study.
Compensation
a. Each minor Participant shall be paid for participation in and successful completion of the Research Study and a specified amount shall be paid collectively to the Guardians) in attendance for participation in and successful completion of the Research Study.
b. In the event a Participant demonstrates repeated instances of dangerous, inappropriate, or behavior that compromises the safety of others, Jack Strategy reserves the right to expel Participant from further participation in the Research Study without the right to compensation.
General
a. This Consent, Waiver and Release Form shall be governed for all purposes by California law, without regard to any conflict of law principles. This Consent, Waiver and Release Form supersedes any and all previous oral or written promises or other agreements.
b. In the event that any provision contained within this Consent, Waiver and Release Form shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this form shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect.
